Town of Independence: Public Hearing on Wind Energy Law

LEGAL NOTICE TOWN OF INDEPENDENCE NOTICE OF PUBLIC HEARING ON PROPOSED LOCAL LAW NOTICE IS HEREBY GIVEN that a public hearing will be held before the town Board of the Town of Independence at the Town Hall, 887 Marietta Avenue, in the Town of Independence, New York at 7pm on the 9th day of December, 2021, concerning proposed Local Law 2 of 2021, entitled “Town of Independence Wind Energy Systems and Facilities Local Law.”

The purpose of the proposed local law is to allow the Town to establish standards and procedures for the Town Board to evaluate applications for construction and installation of wind energy systems and/or facilities within the Town of Independence.

A copy of the proposed local law is available for inspection at the office of the Town Clerk. This local law sets forth the Authority for the Local Law, contains a Statement of Purpose, contains Definitions, states the Applicability of the Local Law, Establishes General Requirements, creates standards for issuing permits for wind energy systems and facilities, establishes safety standards, creates Permit Time Frame and Abandonment standards, authorizes enforcement of the Local Law, and defines severability of the various provisions of the Local Law.

At such time and place all persons interested in the subject matter of the proposed local law will be heard concerning the same. Dated: Town of Independence, New York November 22, 2021
