Allegany County District Attorney reports action against two burglars, Wellsville arsonist

From the Allegany County District Attorney Office:

Defendant’s Name:  Gabriel A. Babbitt

Address:  Wellsville, New York       

Charges:      Burglary 1st (B felony);
Assault 2nd (D felony);
Criminal Possession of a Weapon 4th (A misdemeanor)             

Court Appearance Date:  May 25, 2023

Proceedings:  Gabriel Babbitt has been convicted of Assault in the 2nd degree in Allegany County Court.  Babbitt admitted in court that she committed an assault with a pair of scissors back on August 21, 2022, which caused physical injury to the victim.  Babbitt will be sentenced on August 3, 2023, and faces a state prison sentence.

Defendant’s Name:  Cody A. Hogue

Address:  Belmont, New York       

Charges:      Burglary 3rd (D felony);
Grand Larceny 3rd (D felony);
Criminal Mischief 4th (A Misdemeanor)            

Court Appearance Date:  May 25, 2023

Proceedings:  Cody Hogue was convicted in Allegany County Court of the top charge of Burglary 3rd (a class D felony) following a break-in at Hanson Farms in Belmont on November 17th, 2022.  Hogue will now spend the next 1 – 3 years in state prison in accordance with the sentence handed down by the court.

Defendant’s Name:  Jessica L. Morrison

Address:  Wellsville, New York       

Charges:      Arson 2nd (B felony)
Reckless Endangerment 1st (D felony)
Criminal Mischief 2nd (D felony)             

Court Appearance Date:  May 24, 2022

Proceedings:    Jessica Morrison has been indicted by a grand jury in connection with the fire earlier this month at 46 Broad Street in the Village of Wellsville.  Morrison faces a top charge of Arson in the 2nd degree, a B felony.  Morrison will be arraigned on the indictment in Allegany County Court at a later date.
