Assistant District Attorney Ian M. Jones prosecuting

Defendant’s Name:  Brian J. Learn

Address:  Bolivar, New York       

Charges: Assault on a Police Officer (a class C felony); and
Resisting Arrest (a class A misdemeanor)            

Court Appearance Date:  November 2, 2022

Proceedings:  Brian J. Learn was convicted of Attempted Assault on a Police Officer in Allegany County Court.  Back on January 12, 2022, Learn fled from an officer while under arrest, ultimately causing injury to the officer during a brief struggle.  Learn will be sentenced on January 18, 2022.

Prosecuting Attorney:  Ian M. Jones, 1st Assistant District Attorney     

   

Defendant’s Name:  Stephen A. Frezza and Jessica L. Morrison

Address:  Bolivar, New York       

Charges:      Robbery, 1st Degree (B violent felony);
Menacing (A misdemeanor);
Criminal Mischief (A misdemeanor);
Criminal Possession of Weapon 3rd (D felony)            

Court Appearance Date:  November 2, 2022

Proceedings:  Stephen Frezza and Jessica Morrison were in Allegany County Court for argument of motions on several issues.  Ultimately, three hearings were scheduled for February 1, 2023.  A Huntley hearing was scheduled to determine the voluntariness of the Morrison’s statements to police.  A Wade hearing was scheduled for each defendant, which determines the legality of identification procedures used by law enforcement.  Currently, no trial date has been scheduled.
