1st Assistant District Attorney Ian M. Jones prosecuting

Defendant’s Name:  Stephen A. Frezza and Jessica L. Morrison

Address:  Bolivar, New York       

Charges:      Robbery, 1st Degree (B violent felony);
Menacing (A misdemeanor);
Criminal Mischief (A misdemeanor);
Criminal Possession of Weapon 3rd (D felony)            

Court Appearance Date:  September 7, 2022

Proceedings:  Stephen Frezza and Jessica Morrison were in Allegany County Court for an alleged burglary that took place in the Village of Bolivar on April 24, 2022.  Morrison was arrested on an outstanding warrant while at court, and motions and a pre-trial conference were scheduled for October 5th.   

Defendant’s Attorney:  David Morabito, Sr., Esq. and David Morabito, Jr., Esq.      

Prosecuting Attorney:  Ian M. Jones, 1st Assistant District Attorney     

Defendant’s Name:  Brian J. Learn

Address:  Bolivar, New York       

Charges:      Assault on a Police Officer (a class C felony); and
Resisting Arrest (a class A misdemeanor)            

Court Appearance Date:  September 7, 2022

Proceedings:  Brian J. Learn was back in Allegany County Court for charges including Assault on a Police Officer.  Settlement options were discussed and ADA Ian M. Jones is insisting on a term of state prison.  The offer was not accepted by the defendant and a pre-trial conference has been scheduled for October 5th.

Defendant’s Name:  Jesse W. Schuster

Address:  Fillmore, New York       

Charges:      Criminal Possession of Stolen Property, 4th Degree (E Felony);
Grand Larceny, 4th Degree (E Felony)

Court Appearance Date:  September 8, 2022

Proceedings:  Jesse Schuster was in Hume Town Court after being picked up on a warrant.  Schuster is currently being held on bail in the Allegany County Jail.  The defendant argued for a reduction in bail.  First Assistant District Attorney, Ian M. Jones, argued against a reduction, citing the defendant’s criminal history and prior failure to appear in court.  The court did not reduce bail and Schuster was returned to the Allegany County Jail, with further proceedings scheduled for October 13th.
