Prosecutions by First Assistant District Attorney Ian M. Jones

Defendant’s Name:  Bryan Evans

Address:  Belmont, New York        

Charges:      Violation of Probation            

Court Appearance Date:  May 23, 2022

Proceedings:  A probation violation hearing was held following allegations that Bryan Evans violated his sentence of 179 days of intermittent incarceration previously ordered by the Court.  Following the hearing, the Court extended Mr. Evans’ period of weekend incarceration as a sanction.

Prosecuting Attorney:  Ian M. Jones, 1st Assistant District Attorney      

Defendant’s Name:  Ayden B. Hendricks

Address:  Cuba, New York        

Charges:      Criminal Mischief in the 2nd Degree (a class D felony);
Attempted Arson in the 3rd Degree (a class D felony); and
Reckless Endangerment of Property (a class B misdemeanor).            

Court Appearance Date:  May 23, 2022

Proceedings:  A pre-trial conference was held in the case involving damage to the Palmer Opera House last January.  The purpose of the conference was to determine if the case would be settled short of a trial.  A pre-trial hearing is also scheduled for August 15, 2022, which will determine the admissibility of Hendricks’ statements to police at trial.

Defendant’s Name:  Michael S. McDonald

Address:  Bolivar, New York        

Charges:      Burglary, 1st degree (B violent felony);
Criminal Possession of a Weapon, 4th degree (A misdemeanor);
Menacing, 2nd degree (A misdemeanor);
Criminal Possession of Stolen Property 4th – Firearm (E felony);
Criminal Possession of Stolen Property 5th (A misdemeanor).              

Court Appearance Date:  May 23, 2022

Proceedings:  Michael McDonald was arraigned on 2 separate indictments in Allegany County Court.  Mr. McDonald faces 5 charges in total, including 2 felonies, with the top charge being a B violent felony.  Further proceedings in these matters have been scheduled for June 21st at 10:30.  These cases were presented to the grand jury by 1st Assistant District Attorney, Ian M. Jones.
