Prosecution by 1st Assistant District Attorney Ian M. Jones

Defendant’s Name:  Ayden B. Hendricks

Address:  Cuba, New York        

Charges:      Criminal Mischief in the 2nd Degree (a class D felony);
Attempted Arson in the 3rd Degree (a class D felony); and
Reckless Endangerment of Property (a class B misdemeanor).            

Court Appearance Date:  May 5, 2022

Proceedings:  Ayden B. Hendricks, 21, was in Allegany County Court for pre-trial motions, following an incident at the Palmer Opera House last January.  A Huntley hearing was scheduled for August 15, 2022, which will determine the admissibility of Hendricks’ statements to police at trial.

Defendant’s Name:  Ryan D. McDonald

Address:  Belmont, New York        

Charges:  Assault 2nd (D felony)             

Court Appearance Date:  May 4, 2022

Proceedings:  Ryan D. McDonald was indicted by a grand jury for Assault 2nd (D felony) following a fight within the Allegany County Jail.  The fight is alleged to have resulted in injury to another inmate.

Defendant’s Name:  Lea Falcone

Address:  Fillmore, New York        

Charges:  Violation of Probation

Court Appearance Date:  April 25, 2022

Proceedings:  Lea Falcone was found by the Court to be in violation of her probation conditions and sentenced to 1 year in the Allegany County Jail.

Defendant’s Name:  Mary Jo Ganci

Address:  Belmont, New York        

Charges:  Violation of Probation             

Court Appearance Date:  May 5, 2022

Proceedings:  Mary Jo Ganci was brought before the Allegany County Court for a violation of probation.  The people, represented by Ian M. Jones, argued for Ganci to be held in the Allegany County Jail pending a hearing, which is scheduled for Monday, May 9th.  Ganci was remanded to the Allegany County Jail.

Defendant’s Name:  Romulo A. Mendivil

Address:  Belmont, New York        

Charges:  Course of Sexual Conducted Against a Child (B violent felony)             

Court Appearance Date:  May 5, 2022

Proceedings:  Romulo A. Mendivil was found guilty of Course of Sexual Conduct Against a Child (B violent felony) for incidents which took place in Caneadea in 2020-2021.  Following his conviction, Mendivil was immediately sentenced to 15 years in state prison, followed by 20 years of post-release supervision.  This matter was prosecuted by 1st Assistant District Attorney, Ian M. Jones.

Defendant’s Name:  Michael S. McDonald

Address:  Bolivar, New York        

Charges:      Criminal Possession of Stolen Property 4th – Firearm (E felony)
Criminal Possession of Stolen Property 5th (A misdemeanor)              

Court Appearance Date:  May 4, 2022

Proceedings:  Michael McDonald was indicted by a grand jury for an incident in the Village of Bolivar last December.  When McDonald was arrested he was alleged to be found in possession of a wallet, rifle, and other items that did not belong to him.
