The Honorable Frank Caruso will hear arguments this week

Last month, a now former Allegany County legislator filed a formal complaint in Allegany County Court contending that he was removed from office for political reasons and afforded no due process.
According to Allegany County, Cyr automatically vacated his seat with an address/domicile change. Additionally the county has made it clear that because there were no removal proceedings, the notion of “due process” is a moot point.
Mr. Cyr claims that County Chairman W. Brooke Harris and County Attorney Allison Carrow, “acted as judge and jury to strip Allegany County Legislator Adam Cyr of his seat,” in a recent press release. The county replied that, “It is the County’s position that the law requires us to treat Mr. Cyr’s legislative seat as vacant.“
In pleadings filed last week with the Allegany County court, the county detailed a four point rebuttal to Mr. Cyr’s complaint and a Statement of Facts:
