Gregory Miller will be sentenced on November 23, facing mandatory imprisonment for multiple felony counts

Gregory S. Miller (formerly of Penndel, PA) was found guilty on September 14, 2026, by an Allegany County Jury, to one count of Assault in the First Degree, a class B Violent Felony, one count of Criminal Use of a Firearm in the First Degree, a class B Violent Felony, and one count of Criminal Possession of a Weapon in the Second Degree, a class C Felony.
Mr. Miller was on trial for charges stemming from a July 3, 2024 incident in the Town of Wellsville, wherein he seriously physically injured another person by shooting them with a pistol.
Mr. Miller was remanded into the custody of the Allegany County Jail on September 14, 2026, where he will await sentencing.
Mr. Miller is set to be sentenced on November 23, 2026. Mr. Miller faces mandatory imprisonment on all offenses.
The class B Violent Felonies require a determinate sentence between 5 and 25 years of incarceration with the New York State Department of Corrections, with between 2.5 and 5 years of post-release supervision. The class C Violent Felony requires a determinate sentence between 3.5 and 15 years of incarceration with the New York State Department of Corrections, with between 2.5 and 5 years of post-release supervision.
