Legal action has been filed to protect children from harmful radiation
A COLUMN By Frederick Sinclair
Children’s Health Defense (CHD) was founded in 2016 as a non-profit organization whose mission is “Ending childhood health epidemics by eliminating toxic exposure, holding responsible parties accountable and establishing safeguards. . .” Their ‘mantra’ is Protecting Children. Exposing Harms. Seeking Justice. CHD has formerly announced their launching of an initiative dubbed 704 NO MORE. It is a legal action that is supported by over 100 safe tech, environmental justice and children’s health organizations across the country.
“For decades, Section 704 of the telecommunications Act of 1996 has enabled the uncontrolled expansion of harmful cell towers in our communities – too close to where our children live, learn and play.”
The ‘704 No More’ initiative and pending legal challenge is about protecting children from involuntary exposure to harmful radio frequency (RF) radiation. Section 704 of the Telecom Act:
- Gives the telecom industry the ability to install harmful cell towers and antennas right next to homes, schools, playgrounds and daycares;
- Strips away individual rights, property rights, and freedoms;
- Denies legal recourse to those injured by wireless radiation, leaving them without remedies and compensation; and
- Overrides traditional state police powers that allow us to protect our children’s health and safety on the local level.
CHD believes Section 704 to be unconstitutional. The initiative will:
- Tackle the broad exemption that prohibits local authorities from denying cell tower applications based on health and environmental effects;
- Give you and your community a say when it comes to if and where cell towers are placed in your neighborhood;
- Provide legal recourse for those harmed by wireless radiation; and
- Protect our constitutional rights and freedoms.
It is a fight for children’s health, constitutional and local rights, and the future of our communities. To learn more and support the 704 NO MORE initiative at https://www.704nomore.org and you can find out more about CHD at https://www.childrenshealthdefense.org

The Environmental Health Trust (EHT) is a scientific nonprofit environmental group that maintains a watchful eye and reports on Congressional bills that will increase public exposure to wireless radiation. EHT points out the federal failure to support programs fostering public health, in regards to microwave radiation or investigation into impacts from exposure to RF emissions. There are no active monitoring or compliance programs operating, regardless of evidence showing serious harm to flora and fauna. FCC Wireless radiation exposure guidelines for humans have remained the same since 1996. Federal agencies are failing to recognize the current body of science that identifies the health and environmental impacts of exposure to wireless. Adverse biological effects are being found at levels far below the antiquated FCC human exposure limits. Not only has the FCC failed to meet a Court ordered review of current science and health reports, pending bills before Congress are seeking to fast-track the expansion of wireless infrastructure under the banner of “streamlining”, “removing barriers to entry” and “closing the digital divide”. The bills ignore constitutional protections, conflict with existing federal law, remove states’ rights and would actually perpetuate the digital divide. The Federal Court ruling, indicating the need for revised public exposure levels can be found under: US Court of Appeals for the District of Columbia Docket No. 20-1025 EHT v. FCC 8/13/2021

We will continue to track the progress of legal challenges and Congressional action, as well as examine solutions, in future articles.
