Defendant’s Name:  Michael J. Heverly

Address:  Allen, New York       

Charges:      Arson 3rd degree (C felony);
Criminal Mischief 2nd degree (D felony)
Reckless Endangerment 1st degree (D felony)

Court Appearance Date:  January 3, 2022

Proceedings:  Michael J. Heverly was arraigned in County Court on 3 felony charges.  Heverly is accused of intentionally starting fire to 2 separate buildings on a property in the Town of Allen back in June of this year, destroying one and damaging the other.  Motions and further proceedings are scheduled for March 6, 2023.

Address:  Belmont, New York       

Charges:      Criminal Mischief 3rd (E felony);
Criminal Tampering 3rd (B misdemeanor)

Court Appearance Date:  January 4, 2022

Proceedings:  Dylan Perkins was arraigned on an indictment in Allegany County Court and pled not guilty on both charges.  Assistant District Attorney, Ian M. Jones, requested a trial date, and the trial has been scheduled for July 10–14, 2023

Defendant’s Name:  Brandon Short

Address:  Wellsville, New York       

Charges:      Arson 2nd (class B felony);
Criminal Mischief 4th (class A misdemeanor)

Court Appearance Date:  January 4, 2022

Proceedings:  A competency hearing was conducted in Allegany County Court to determine if the defendant is an “incapacitated person”.  The defendant argued that he is incapacitated and unable to stand trial.  The People, represented by Ian M. Jones, argued that the defendant is not incapacitated and is fit to proceed to trial.  After witness testimony and other evidence was presented, the Court agreed with the People’s position and determined that the defendant was fit to proceed to trial.  This case will be back in County Court on February 22, 2023.
