1st Assistant District Attorney Ian M. Jones is prosecuting these four cases

Defendant’s Name:  Brian J. Learn

Address:  Bolivar, New York        

Charges:      Assault on a Police Officer (a class C felony); and
Resisting Arrest (a class A misdemeanor) 

Court Appearance Date:  March 16, 2022

Proceedings:  Brian J. Learn was arraigned on an indictment for an incident involving the assault of a police officer in the Village of Bolivar.  Further proceedings and motions have been scheduled for May 4, 2022.

Defendant’s Name:  Mary Jo Ganci

Address:  Belmont, New York        

Charges:  Violation of Probation             

Court Appearance Date:  March 18, 2022

Proceedings:  Mary Jo Ganci was in Allegany County Court for a violation of probation.  The people, represented by Ian M. Jones, argued for incarceration.  A hearing has been scheduled for April 22, 2022.

Defendant’s Name:  Bryan Evans

Address:  Belmont, New York        

Charges:      Violation of Probation

Proceedings:  Bryan Evans was found to be in violation of his probation conditions and was sentenced to 6 months of intermittent incarceration in the Allegany County Jail.

Defendant’s Name:  Ruth Foth

Address:  Bolivar, New York        

Charges:  Fugitive from Justice           

Court Appearance Date:  March 22, 2022

Proceedings:  Ruth Foth was arrested on a fugitive from justice warrant and brought before the Allegany County Court.  Extradition proceedings were waived and Ms. Foth was returned to Potter County, PA on the warrant.
