The Allegany County Sheriffโ€™s Office would like to make the public aware of the ๐—ฎ๐—ฝ๐—ฝ๐—น๐—ถ๐—ฐ๐—ฎ๐—ฏ๐—น๐—ฒ ๐—น๐—ฎ๐˜„ regarding UTV operation, as clarified in a letter from the ๐—ก๐—ฒ๐˜„ ๐—ฌ๐—ผ๐—ฟ๐—ธ ๐—ฆ๐˜๐—ฎ๐˜๐—ฒ ๐——๐—ฒ๐—ฝ๐—ฎ๐—ฟ๐˜๐—บ๐—ฒ๐—ป๐˜ ๐—ผ๐—ณ ๐— ๐—ผ๐˜๐—ผ๐—ฟ ๐—ฉ๐—ฒ๐—ต๐—ถ๐—ฐ๐—น๐—ฒ๐˜€.

The Department of Motor Vehicles (DMV) has received your correspondence wherein you ask several questions regarding the operation of UTVs on public highways.

1)๐—–๐—ฎ๐—ป ๐—ฎ ๐—จ๐—ง๐—ฉ ๐—ฏ๐—ฒ ๐—ฟ๐—ฒ๐—ด๐—ถ๐˜€๐˜๐—ฒ๐—ฟ๐—ฒ๐—ฑ ๐—ถ๐—ป ๐—ก๐—ฒ๐˜„ ๐—ฌ๐—ผ๐—ฟ๐—ธ ๐—ฆ๐˜๐—ฎ๐˜๐—ฒ ๐—ฎ๐—ป๐—ฑ ๐—ผ๐—ฝ๐—ฒ๐—ฟ๐—ฎ๐˜๐—ฒ๐—ฑ ๐—ผ๐—ป ๐—ฝ๐˜‚๐—ฏ๐—น๐—ถ๐—ฐ ๐—ฟ๐—ผ๐—ฎ๐—ฑ๐˜€?

๐—”๐—ป๐˜€๐˜„๐—ฒ๐—ฟ: โ€œA UTV cannot be registered in NYS or operated on public highways. UTVs fall within the definition of a โ€˜motor vehicleโ€™ outlined in New York State Vehicle and Traffic Law (VTL) ยง125 (โ€˜propelled by a power other than muscular powerโ€™), and must therefore be registered to be operated on a public highway under VTL ยง401(1)(a). However, UTVs are currently unregisterable as there is no registration class for such a vehicle currently listed in VTL ยง401.โ€

๐—”๐—ป๐˜€๐˜„๐—ฒ๐—ฟ: โ€œNo, because a vehicle type that cannot be registered in this state may not operate in this state even if it is registered in another state.โ€

4)๐—–๐—ฎ๐—ป ๐—ฎ ๐—จ๐—ง๐—ฉ ๐—พ๐˜‚๐—ฎ๐—น๐—ถ๐—ณ๐˜† ๐—ฎ๐˜€ ๐—ฎ ๐˜€๐—น๐—ผ๐˜„-๐—บ๐—ผ๐˜ƒ๐—ถ๐—ป๐—ด ๐˜ƒ๐—ฒ๐—ต๐—ถ๐—ฐ๐—น๐—ฒ ๐—ณ๐—ผ๐—ฟ ๐—ผ๐—ฝ๐—ฒ๐—ฟ๐—ฎ๐˜๐—ถ๐—ผ๐—ป ๐—ผ๐—ป ๐—ฝ๐˜‚๐—ฏ๐—น๐—ถ๐—ฐ ๐—ต๐—ถ๐—ด๐—ต๐˜„๐—ฎ๐˜†๐˜€?

๐—”๐—ป๐˜€๐˜„๐—ฒ๐—ฟ: โ€œNo. The display of a slow-moving vehicle emblem does not convert a UTV into, nor qualify it as, a slow-moving vehicle for operation on the public highways. VTL ยง375 (36)(c) states in part, โ€˜[S]uch emblem shall be used only on farm machinery and implements of husbandry on road construction and maintenance machinery, and on such other vehicles, machinery and equipment as may be specified in regulations issued by the commissioner …โ€™ Pursuant to 15 NYCRR 68.8, โ€˜[T]he only use of the slow-moving vehicle emblem shall be as follows: (a) Agricultural equipment, whether towed or self-propelled, designed for operation at speeds not in excess of 25 miles per hour, when traveling on or moving along a public highway during day or night, shall each display the slow-moving vehicle emblem …โ€™ Therefore, since UTVs are not the types of vehicles described above, UTVs are not permitted to operate on public highways by displaying slow-moving vehicle emblems.โ€

5)๐—–๐—ฎ๐—ป ๐—ฎ ๐—จ๐—ง๐—ฉ ๐—ฏ๐—ฒ ๐—ฑ๐—ฒ๐—ฐ๐—น๐—ฎ๐—ฟ๐—ฒ๐—ฑ ๐—ฎ๐˜€ ๐—ฎ ๐—™๐—ฎ๐—ฟ๐—บ/๐—”๐—ด๐—ฟ๐—ถ๐—ฐ๐˜‚๐—น๐˜๐˜‚๐—ฟ๐—ฎ๐—น ๐˜ƒ๐—ฒ๐—ต๐—ถ๐—ฐ๐—น๐—ฒ?

๐—”๐—ป๐˜€๐˜„๐—ฒ๐—ฟ: โ€œNo. The key to determining whether a UTV can be defined as a farm/agricultural vehicle can be found in VTL ยง100-d which defines โ€˜agricultural equipmentโ€™ as being โ€˜[e]very agricultural tractor, self-propelled implement of husbandry, and towed, mounted or semi-mounted implement of husbandry.โ€™ โ€˜Implement of husbandryโ€™ shall mean a vehicle designed or adapted exclusively for agricultural, horticultural or livestock raising operations or for lifting or carrying an implement of husbandry. It is our opinion that the language โ€˜designed or adapted exclusively forโ€™ agriculture would exclude a stock UTV, and the term โ€˜agricultural tractorโ€™ refers to a farm tractor designed specifically for agriculture. While a UTV that has been adapted exclusively for agricultural and used exclusively for agriculture might be considered a farm vehicle, or โ€˜agricultural equipment,โ€™ it would ultimately be a fact-based determination.โ€

๐—”๐—ป๐˜€๐˜„๐—ฒ๐—ฟ: โ€œOperation of UTVs on public roads is prohibited.โ€

Additionally, after a check with a local insurance company and their conversation with their underwriter; when you get insurance for your UTV (side by side), the insurance only covers the vehicle and occupants when the vehicle is being operated legally in an area where it is legally allowed. In other words, you are not covered when you operate it on any public highway. That means you can be held personally responsible for any injuries or property damage in any accident, whether or not you are at fault.
